Governança na Lagoa da Conceição

The present research intends to demonstrate a practical work carried out through a class action proposed by research groups in environmental law of the Federal University of Santa Catarina, Florianópolis, Brazil. Lagoa da Conceição, a lagoon located in the city of Florianópolis, Brazil, is an ecosystem with socio-ecological complexity. Currently, with increasing development, its ecosystem diversity is threatened. The increase in the urban population, tourism, real estate speculation and complications in the sanitary system are characteristics that have affected the place over the years. In January 2021, a dam at the Lagoa Sewage Treatment Station broke, which have impacted the community, the ecosystem, and the lagoon with untreated sewage. This occurrence initiated the class action proposed by the research groups with the purpose of protecting Lagoa da Conceição from collapse. The action aims to recognize Lagoa da Conceição as a subject of rights as well as to establish a Judicial Protection Assembly that aims to apply structuring measures in order to assist the judge in carrying out actions in search of preserving environmental management in the region. The Judicial assembly for the protection of Lagoa da Conceição will use geographic information to assist the judge in applying the structuring measures and elucidate what problems occur in the area. Thus, through a management, control and monitoring instrument, the application of spatial data makes it possible to locate problems efficiently. This perspective aims at building a governance based on a preventive ecological approach, since from the geographic data collected, the assessment of problems becomes viable and helps in the formation of effective institutions in local governance, preventing new harmful events. By involving all actors, preventive governance emerges as a true appeal to responsibility for the protection of nature, and as a reflection of an Ecological Right.
